The information we handle (collect, store, use, circulate, and delete) about you depends on the stakeholder group to which you belong and how we interact with you. Personal Data is information that identifies you, is linked to you, or can be associated with you. This includes information that could be used to locate or contact you. 2.1. Individual identification information. It is information that identifies a natural person, information linked to or that can be linked to a specific or determinable natural person ("Personal Data"). This information may include, among others, Commercial Information.

Regarding Commercial Information. When using our Services or Solutions, we may ask you to provide Commercial Information that links you to the company where you work, such as contact information, information about your position, and your functions in the company where you work; as well as information about the practices, policies, processes, and supporting documentation of the company where you work. This Commercial Information is stored in our systems, and we use it to provide the Services you have contracted on the terms of the agreements we enter into with your company.
 

2.2. Unidentified and non-identifiable information that belongs to you. This information is collected through the use of our websites or our Services and is information that does not allow the identification of users ("Non-Personal Data"). Non-Personal Data may include usernames, server names, shared resource names, file names, settings, browsing events, and technical information transmitted by your device, including certain software and hardware information (e.g., the type of browser and operating system your device uses, language preference, access time, and the domain name from which the software was linked; etc.). If you send us Personal Data related to another person, you declare that you have the authorization to do so and allow us to use this Personal Data in accordance with this Privacy Policy.

4.1.       If you are an employee, job applicant or former employee
We process your Personal Data to execute our legal and contractual obligations with you, in particular, to fulfill the following purposes:

Develop recruitment, evaluation and employment processes; make security studies, including polygraph tests; send communications useful for the aforementioned processes; and, know and evaluate the information related to their academic, professional and job activities.
Carry out all the necessary activities to execute the existing contracts with the workers and their obligations, including making the payment of salaries, social benefits and others that arises from the employment relationship.
Verify the compliance of Lexica´s internal policies and the business purposes, including but not limited to compliance with legal or contractual obligations to third parties.
Manage the information and communication systems of Lexica, including, backup copies and files of the information contained in the devices provided by Lexica.
Carry out corporate welfare programs for employees, of vigilance of the Social Security and Health Management System and health promotion and prevention activities.
Submit information before entities of the Social Security and Health Management System, including the request for reimbursement for payments of licenses or disabilities to the competent organizations, including Health Maintenance Organizations, among others. Likewise, in front of financial entities for the analysis of benefits, such as drafts.
Send communications by courier, e-mail, mobile devices, or through any other analog and/or digital means of communication with commercial, advertising or promotional information about services, events, promotions, campaigns and/or contests of a commercial or advertising nature, advanced by Lexica.
Verify your information in credit bureaus to use it as an element of analysis in the employment relationship.
Submit information to control and surveillance authorities, support internal or external audit processes and carry out statistical studies or accounting processes.
Send information related to the liquidation, culmination of activities and participation in future selection processes, after the termination of the employment contract.

4.2.       If you are a contractor or supplier we process your Personal Data to execute our legal and contractual obligations with you, in particular, to fulfill the following purposes:

Contact and contract with providers of services or products that Lexica required for the development of its activities and the provision of its facilities; as well as making the necessary requests to report the accounting, legal and tax information related to them.

4.3.       If you are our client or potential client we process your Personal Data for the following purposes:

Provide the contracted services and allow the use of the contracted Solutions; as well as carrying out satisfaction surveys and monitoring the provision of the Services.
Send communications by courier, e-mail, mobile devices, or through other communication means with commercial, advertising, or promotional information about services, events, promotions, and/or contests of a commercial or advertising nature, related to Lexica.
Process orders, requests or any type of petition that is made by the client through any of the contact forms that are made available to them.
Make statistical or data analytics studies.
Inform about changes in data privacy policies.
Submit information before control and surveillance authorities.

HOW DO WE PROCESS PERSONAL DATA IN OUR PARTNER PROGRAM?

It is the Relationship Program of LEXICA which study, analyze and evaluate requirements that an interested party must have to be selected by LEXICA as a Business Partner and during which the categorization of your membership will be make. This Relationship Program allows us to know you, understand your experience and your experience in the industry. Therefore, we will need to access your Personal Data and process it in the terms established in this section.

In case that you act on behalf of an entity during our Relationship Program, we will require Personal Data from your partners, employees, affiliates, associates, or representatives to continue with our selection process. In these cases, you declare that you are authorized by your partners, employees, affiliates, associates, or representatives to handle their information, and allow us to process it to fulfill the following purposes:

Carry out the activities included in the Relationship Program.
Review and analyze the documents you provide us, including the evaluation of your technical, economic, commercial, and legal capacities and your legal representatives, shareholders, employees, contractors and member teams.
Send communications about the Relationship Program, get in touch to request necessary information, as well as request clarifications or confirmations about the information provided by you.

5.3       Processing of Personal Data in the training stage

Our Relationship Program has a training phase in which we train you (and the employees and contractors you select) in the commercial and technical matters that our Business Partners must manage. The registration of the training sessions will require you to provide us the Personal Data (name, email, professional profile, professional experience and its associated certifications or any other associated information to the professional resume) of the employees, contractors and members of your team who will participate in the training sessions.

In this case, you declare that you are authorized by your employee, contractor or member of your team for us to process their Personal Data and allow us to process it in order to contact them and indicate the steps they must follow to register on our platform learning website and access training sessions. At the time of registration, we will require these interested parties with their informed consent to fulfill the following purposes:

Carry out all the necessary activities to participate in the training sessions related to our business model and our products, Services and Solutions.
Hire the Services or products necessary for the development of our activities and the provision of our facilities.
Verify information on restricted lists, credit bureaus and criminal or disciplinary information centers, as well as carry out customer awareness and due diligence processes.
Send communications with commercial or marketing information about products, services, campaigns, and events that we promote with our business partners or customers.

5.4.       Processing of Personal Data in case of not passing the Relationship Program
In case that you or the entity you represent do not pass the Relationship Program, we will keep your Personal Data and process it for the following purposes:

Send information about new invitations to participate in the business plans that we develop, and about commercial alliances that you may be interested.
Send communications with commercial or marketing information about products, services, campaigns, and events that we promote with our business partners or customers.

5.5.       Obligations of the participants in the formation stage
We will provide participants in the training stage a personal username and password to access our web-based learning platform (“Access Controls”). These Access Controls will be for the sole and exclusive use of the respective user, for which each user agrees to:

Do not transfer your Access Controls to third parties.
Do not allow third parties to know or make use of your Access Controls.
Do not make inappropriate use of your Access Controls.
Keep your Access Controls in secure media, out of the reach of third parties.
Modify your Access Controls periodically, or immediately in case of loss or disclosure.
Comply with the security practices that we recommend in our communications.

In addition, it is your responsibility to maintain control of the Access Controls and avoid third parties access them. Therefore, you are responsible for controlling the devices used to access our web learning platform using your username and not revealing the password associated with your username to anyone.

WITH WHOM DO WE SHARE YOUR PERSONAL DATA?
Your Personal Data may be stored and processed in any country where we have facilities or service providers; and, by using our Services or providing us your consent (where required by law), your Personal Data may be transferred to countries outside of your country of residence and even to the United States for which we will implement measures to protect Personal Data. This Supplemental Privacy Notice for residents of Colombia is in addition to the information contained in the Global Privacy Policy of Lexica (above) and apply only to residents of Colombia (“You”).
